Work/Rest Cycle Agreement Modifications

1. Extra engineers who take a non-compensated leave/absence will forfeit guarantee for current payroll period.


2. Eliminate ability to exercise "hold down," "old head" or "pass-up" rules while assigned on work/rest extra board.

3. Eliminate DEW list. No duty calls on rest days

4. Vacation scheduled as a single week must be scheduled to include a minimum of (2) rest cycle days. Two or more weeks of vacation scheduled consecutively must be taken as a single block. (Each week cannot be scheduled independently.) The start of a vacation of 2 or more weeks in duration may be moved to coincide with start of a work week.

5. Extra engineers will be required to use personal leave day(s), If any, or single day(s) vacation, If any, before taking uncompensated leave. One personal leave day or single day vacation must be used for each 24-hour period, or portion thereof, extra engineer is absent.

6. An extra engineer still observing his/her rest day(s) (due to trespassing) when his/her work group returns to service will be returned to extra board with his/her work group and accordingly move up the board. 7. "Undisturbed Hours-of-Service Rest" rule will not apply after a call and release (where no duty is performed).

8. Extra engineer assigned to an outside vacancy will be returned to extra board on rest days of such outside assignment and will not be permitted to observe rest days of the outside assignment/vacancy.

9. Interpret existing work/rest cycle agreement provisions to permit implementation of CMS addition/reduction matrix and universal calendar.

10. BLE agrees to implement these provision pending ratification for the El Paso East and El Paso West extra boards. Implementations are to be effective 12:01 a.m. MST March 1, 2001.

11. Concurrent with implementation of these provisions, UPRR will withdraw its notice to cancel the work/rest cycle agreements for the El Paso East and El Paso West extra boards.

12. UPRR and BLE will promptly meet to develop and finalize agreement language covering these provisions for BLE ratification.

13. UPRR and BLE will promptly meet to develop and finalize crew scheduling arrangements for pools protected by the El Paso East and West extra boards.
